I didn't read anywhere in the article that Mr. Cuthbert had an agreement with
the website's owner to carry out penetration testing. Am I missing the point?

Much like if I were to come into your home and watch Television because I felt like it. No malicious intent, just curiosity, free television and availability because I could. Cyber Trespassing is a bad thing, and yes, it is the onus of the web-site owner to secure their property. I lock my doors. do you?
